CityArtWalks reserves the right to remove content at its sole discretion.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification.

Your counter-notice must include:

1. Your physical or electronic signature
2. Identification of the material that has been removed or disabled and its prior location
3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
4. Your name, address, and contact information
5. A statement that you consent to the jurisdiction of the federal court in your district (or your location if outside the United States), and that you will accept service of process from the original complainant

Upon receipt of a valid counter-notification:

• We may restore the content within 10-14 business days
• Unless the original complainant files a court action seeking to restrain the alleged infringement

5. Repeat Infringer Policy

CityArtWalks maintains a policy of terminating accounts of repeat infringers.

Users or moderators who are found to repeatedly upload infringing content may have their accounts suspended or permanently removed at our sole discretion.

6. Moderator Responsibility

CityArtWalks operates a curated platform where designated city moderators are responsible for uploading content, including images and descriptions.

By submitting content, moderators represent and warrant that:

• They own or have obtained all necessary rights and permissions to use and display the content
• The content does not infringe upon any third-party intellectual property rights
• They grant CityArtWalks a worldwide, non-exclusive, royalty-free license to display and distribute the content

Moderators agree to indemnify and hold harmless CityArtWalks from any claims arising from content they upload.

7. AI-Generated Content

Some descriptions and content on CityArtWalks may be generated or assisted by artificial intelligence and reviewed by moderators.

We do not guarantee the accuracy, completeness, or originality of such content. Any concerns regarding content accuracy or ownership should be reported using the process outlined above.

8. Misrepresentation

Any person who knowingly submits a false DMCA notice or counter-notice may be liable for damages under applicable law.
